Former employee accuses Midas Auto Service of violating labor code

FRESNO — A former employee is suing Midas, alleging violations of labor codes.

Christopher Perkins filed a complaint Dec. 18 in Fresno County Superior Court against Agri Center Auto Parts Inc. d/b/a Midas Auto Service Experts and Does 1-50, alleging they failed to provide employees proper wages, benefits and incentives.

According to the complaint, Perkins worked for Midas as a store manager between Dec. 26, 2014, and Oct. 23, 2017. Perkins says he has suffered economic injury or loss of earnings, for not being properly compensated by Midas including minimum and overtime wages, and mandated rest periods or compensation for unused rest periods. 

The plaintiff alleges the defendants failed to pay minimum and overtime wages, failed to authorize Perkins to take rest/recovery periods in accordance with the law, and failed to provide compensation in lieu of the rest/recovery periods which were not provided.

Perkins seeks trial by jury, liquidated damages of $42,268, compensatory damages, interest, costs of suit, attorney fees and other relief the court deems just. He is represented by attorney Gregory L. Myers of Law Offices of Gregory L. Myers in Fresno.
