Fresno County property owners accuse developer, contractors of breach of contract

FRESNO — Seven Fresno County property owners are suing a developer and contractors, alleging breach of contract, breach of implied warranty, breach of express warranty, negligence and strict product liability.

Joseph and Stephanie Grogg, Samy Ghabrial and Soheir Z. Attia, Ali Abuelreish and Jeffrey and Blair Rodriguez filed a complaint Dec. 18 in Fresno County Superior Court against Lennar Fresno Inc. and Does 1-1,000, alleging they owe $50,000 per home complaint. 

According to the complaint, the plaintiffs have suffered economic injuries from being forced to incur expenses for the restoration and repairs of their properties on West Vermont Avenue, West Loyola Avenue, West Warwick Avenue and and West Serena Avenue in Fresno, and to remedy the defects and deficiencies that were caused by the defendants. 

The plaintiffs allege Lennar Fresno caused diminution in the value of their property, and forced them to retain expert consultants to determine the extent of the defects and damages,.

The plaintiffs seek trial by jury, costs of repairs in excess of $50,000 per home, costs of investigation, expert fees, costs of suit, and all further relief the court deems just. They are represented by attorneys Michael K. Fairchild of Milstein Jackson Fairchild & Wade LLP in Los Angeles.
