Real estate investor accuses partners of negligent misrepresentation

FRESNO — A Fresno man is suing real estate investor, alleging negligent misrepresentation and fraud.

Ezequel Guzman filed a complaint Dec. 18 in Fresno County Superior Court against La Daga Investments LLC, Rene Esquivel, and Does 1 through 10 alleging the defendants failed to perform all conditions, covenants and promises in accordance with the terms and conditions of their contract.

According to the complaint, in October 2015, Guzman was induced by defendants to invest in 11 real estate properties and was promised to be paid a $70,000 return on his investment of $150,000. Guzman says he was paid $115,000, but he was entitled to the total amount for his investment of $220,000, leaving an unpaid balance of $105,000.

The plaintiff alleges the defendants have refused to pay the balance due and owing, and have only made partial payments by issuing check with insufficient funds.

Guzman seeks trial by jury, damages not less than $105,000, plus interest, costs of suit, attorney fees and all further relief the court deems just and proper. He is represented by attorney Randolf Krbecheck of Law Offices of Randolf Krbecheck in Fresno.
