FRESNO — A leasing and financing company is suing a customer, alleging breach of contract in failing to pay $47,000.
Hitachi Capital America Corp. filed a complaint Dec. 22 in Fresno County Superior Court against CHD Transport Inc., Balvinder Singh, and Does 1 through 10, alleging that the defendants breached the motor vehicle security agreement due to defaulted payment under terms of the contract.
According to the complaint, on March 6, 2015, the parties agreed to a written motor vehicle security agreement created by defendants in purchasing their vehicle. Despite performing all obligations, Hitachi Capital says it has failed to receive the deficient balance of $47,040,11 after taking possession of the vehicle when the defendants defaulted on payments due.
The plaintiff alleges the defendants refused to pay the deficient balance together with late charges, expenses, and accrued interest as part of the contract.
Hitachi Capital America seeks trial by jury, judgment for the principal sum of $47,040.11, plus late charges, expenses and interest, along with attorney fees, costs of suit and all other relief the court deems just and proper.
