Recycling company alleges client owes more than $37,000

FRESNO — A recycling system company is suing an equipment manufacturer, alleging breach of contract in its failure to pay more than $37,000.

Pavement Recycling Systems Inc. filed a complaint Dec. 21 in Fresno County Superior Court against Cen-Cal Machinery Co, Inc. and Does 1-10, alleging the defendant failed to pay for outstanding invoices in connection with the goods and services received.

According to the complaint, on May 3, 2017, Pavement Recycling sent a written invoice to Cen-Cal in connection with the payment for providing goods and services at the specific request of the defendants. Despite repeated demands, the suit says the plaintiff has failed to receive any payment amounting to $37,662.50, plus interest at the legal rate. 

The plaintiff alleges Cen-Cal Machinery has continued to refuse to pay the balance owing despite repeated demands.

Pavement Recycling Systems seeks trial by jury, judgment of $37,662.50, plus costs of suit, and all other relief the court deems just and proper. They are represented by attorney Karel Raba of The Moore Law Group in Santa Ana.
