Mother, minor daughter allege medical center breached agreement

FRESNO — A mother and her minor daughter are suing medical facility, alleging refusal to accept reduction of lien.

Lidia Vasquez Rios, a minor through her guardian Josefina Rios, filed a complaint Dec. 22 in Fresno County Superior Court against Adventist Medical Center, Department of Health Care Services, Specialized Collection Systems and Does 1 to 10, alleging the defendants refused to accept any settlement offers involving car crash injuries despite multiple attempts to reach a settlement

According to the complaint, on Feb. 6, 2014, Vasquez Rios, who was riding a bicycle, was run over by a motor vehicle. The suit says after being treated by defendants and agreeing to settle claims against the at-fault party for the policy limit of $15,000, the defendants refused to reduce its claim of $6,260 against any and all settlement, judgments. 

As a result, the suit says, the plaintiffs continue to suffer financial and other burdens that keep them from seeking care and treatment because of their unsettled state of affairs. 

The plaintiffs allege the defendants made unreasonable demands that prevented reaching a settlement agreement and refuse to accept any settlement offers. The suit says this prevents Vasquez Rios from obtaining proper and professional future care to treat her ongoing symptoms.

The plaintiffs seek trial by jury, a discharge from all liability, court costs and all other relief the court deems just and equitable. They are represented by attorney and Arash Arjang of Yarra Law Group in Fresno.
