Disabled customer accuses Subway owner of discrimination

LOS ANGELES — A disabled man who requires a cane for walking is suing the owner of a Los Angeles Subway store, alleging disability discrimination.

Soo Oh filed a complaint Jan. 15 in U.S. District Court for the Central District of California against Nate Management, LLC and Does 1-10, alleging violation of the American with Disabilities Act and Unruh Civil Rights Act.

According to the complaint, in December 2017, Oh went to the Subway at 15232 Saticoy St., Los Angeles, to patronize its business. The suit says despite the Subway being a public facility, Oh encountered problems in the parking lot as the premises had no procedure policy in place to maintain parking spaces reserved for persons with disabilities. 

As result, Oh says he was denied full and equal access to the Subway which caused him difficulty and frustration. 

The plaintiff alleges Nate Management failed to maintain in working and usable conditions those features required to provide ready access to persons with disabilities.

Oh seeks trial by jury, actual damages and a statutory minimum of $4,000, attorney fees, litigation expenses and costs of suit. He is represented by attorney Jong Yun Kim of Law Offices of Jong Yun Kim in Los Angeles.
