LOS ANGELES — A Woodland Hills woman is suing a Florida debt collector, alleging violation of the Telephone Consumer Protection Act (TCPA).
Giselle Shapiro filed a complaint Jan. 16 in U.S. District Court for the Central District of California against Ocwen Loan Servicing LLC of West Palm Beach, Florida, alleging violation of the TCPA through intrusive and unwanted phone calls.
According to the complaint, Shapiro has suffered a significant amount of anxiety, frustration and annoyance as a result of receiving several unwanted calls from Ocwen Loan in its attempt to collect an alleged debt.
The plaintiff alleges Ocwen Loan Servicing continued placing automated calls to her cellular telephone despite Shapiro's repeated demands to stop the calls. The suit says the calls interfered with the plaintiff’s right to peacefully enjoy the cellular phone service for which she paid.
Shapiro seeks trial by jury, statutory damages of $500 for each violation and $1,000 for each willful violation, actual damages, costs of litigation, attorney fees, punitive damages and all further just relief. She is represented by attorney Trinette G. Kent of Lemberg Law LLC in Phoenix.
