Owners of E&M Auto Parts accused of violating Americans with Disabilities Act

SAN DIEGO — A man who is confined to a wheelchair is suing the owners of an El Cajon auto parts store, alleging failure to uphold the Americans with Disabilities Act regulations.

Chris Langer filed a complaint on Jan. 17 in the U.S. District Court for the Southern District of California against Joan G. Manuele, trustee for the business' owners, alleging that the owners failed to provide proper accommodations to the plaintiff to address his disability.

According to the complaint, the plaintiff alleges that in October 2017, he was denied access to E&M Auto Parts because it did not have any parking space marked and reserved to persons with disabilities. 

The plaintiff holds Manuele responsible because she allegedly failed to provide and reserve a parking space for disabled customers including the plaintiff.

The plaintiff seeks injunctive relief, an order for the defendant to comply with the American with Disabilities Act, actual damages, and court costs. He is represented by Isabel Masanque, Ray Ballister Jr., Phyl Grace and Dennis Price of the Center for Disability Access in San Diego.
