Customer accuses debt collector of violating FDCPA

SAN DIEGO — A San Diego County woman is suing a debt collector, alleging violation of the Fair Debt Collection Practices Act (FDCPA).

Jacqueline Hudspeth filed a complaint Jan. 18 in U.S. District Court for the Southern District of California against Brightwater Capital LLC, alleging the defendant violated FDCPA through abusive, deceptive and unfair debt collection practices.

According to the complaint, in August 2017, Hudspeth suffered harm and damages from receiving a letter from Brightwater in an attempt to collect an alleged debt. The suit says the defendant continued to send communications despite Hudspeth's notice in writing to cease further communication. 

The plaintiff alleges Brightwater Capital illegally contacted her without express consent and invaded her rights to privacy and seclusion.

Hudspeth seeks trial by jury actual damages, damages up to $1,000 for every willful violation, statutory damages of $1,000, costs of litigation, attorney fees and all other relief the court deems proper. She is represented by attorney Eric A. LaGuardia of LaGuardia Law in San Diego.
