U.S. contractors allege companies owe more than $50,000

SACRAMENTO — A United States contractor corporation is suing a construction company and an insurance company, alleging they owe more than $51,000 for breach of contract.

United States for the use and benefit of Paradigm Mechanical Corp. and Paradigm Mechanical Corp. filed a complaint Jan. 19 in U.S. District Court for the Eastern District of California Sacramento Division against Bishop Inc., Aegis Security Insurance Company and Does 1 through 5, alleging the defendants defaulted on payment as required under the agreed contract.

According to the complaint, between May 31-Dec. 23, 2016, the plaintiff entered into a subcontract and tolling agreement with the defendants for work at the DDJC Tracy site. The suit says the defendants agreed to pay for any material, equipment, labor, supplies and services furnished by the plaintiffs. 

The suit states the defendants have breached its contract by failing to pay the amount due.  The plaintiffs allege the defendants have failed to fulfill its obligation under the bond to pay for labor, materials and services furnished amounting to $51,360 in the prosecution of the work provided for in the prime contract and in the subcontract.

The United States and Paradigm Mechanical seek trial by jury, the principal sum in excess of $51,360, plus attorney fees, prompt payment penalties, costs of suit and all other relief the court deems just and proper.
