LOS ANGELES — A disabled California man is suing a North Hollywood property owner, alleging failure to uphold Americans with Disabilities Act (ADA) regulations.
Gary Scherer filed a complaint Jan. 22 in U.S. District Court for the Central District of California against Hermandad Mexicana Nacional and Does 1-10, alleging they failed to provide full and safe equal access to their facilities.
According to the complaint, in November 2017, when Scherer was at 11559 Sherman Way, North Hollywood, he encountered architectural barriers while visiting the defendants' facility. The suit says this caused Scherer difficulty and frustration because the single van-accessible parking space was inadequate in width and the restroom lacked specific equipment to accommodate persons with disabilities.
The plaintiff alleges the defendants failed to provide adequate facilities and equipment for the use of persons with disabilities, in violation of ADA regulations.
Scherer seeks trial by jury, actual damages and a statutory minimum of $4,000, injunctive relief, attorney fees, litigation expenses and costs of suit. He is represented by attorney Isabel Masanque of Center for Disability Access in San Diego.
