Man alleges College Greens Executive Plaza LLC property doesn't have accessible parking lot

SACRAMENTO – A Sacramento property is alleged to have an inaccessible parking lot to individuals with disabilities.

Scott Johnson filed a complaint on Jan. 25 in the U.S. District Court for the Eastern District of California against College Greens Executive Plaza LLC and Does 1-10 citing the Americans with Disabilities Act.

According to the complaint, the plaintiff alleges that in February and again in March 2017, he went to the defendant's property. The suit states the plaintiff is a quadriplegic and uses a wheelchair for mobility. He alleges the property had no compliant, accessible handicap parking spaces for patrons with disabilities and that he also encountered barriers in the restroom.

The plaintiff holds College Greens Executive Plaza LLC and Does 1-10 responsible because the defendants allegedly failed to make reasonable modifications in policies, practices, or procedures that are necessary to afford accommodations to persons with disabilities.

The plaintiff requests a trial by jury and seeks judgment against defendants, award of actual damages, injunctive relief and attorney's fees, litigation expenses and costs of suit. He is represented by Ray Ballister Jr., Isabel Masanque, Phyl Grace and Dennis Price of Center for Disability Access in San Diego.
