SAN DIEGO – An exclusive licensee of tooth-whitening mouthpieces alleges that two Chula Vista corporations have infringed patented designs.

Glo Science Inc. filed a complaint on Jan. 30 in the U.S. District Court for the Southern District of California against Angelo De Simone, TrueCompany Limited and Million Dollar Smile LLC alleging patent infringement.

According to the complaint, the plaintiff is the exclusive licensee of JBL Radical Innovations and alleges that the defendants make and/or sell mouthpieces that infringe JBL patents.

The plaintiff holds De Simone, True Company Limited and Million Dollar Smile LLC responsible because it alleges the defendants' infringement has damaged it.

The plaintiff requests a trial by jury and seeks judgment against defendants, award damages, attorneys' fees, interest, costs and expenses, and further relief as it may deem just and proper. It is represented by Brett N. Taylor of Cozen O'Connor in Los Angeles, Amy B. Alderfer of Cozen O'Connor in Santa Monica, David B. Sunshine of Cozen O'Connor in New York, and Jay Spiegel of H. Jay Spiegel & Associates in Mount Vernon, Virginia.
