Consumer claims Wells Fargo Bank submitted unauthorized inquiry to credit bureau

SAN DIEGO – A San Diego County consumer alleges a financial institution submitted an unauthorized consumer report inquiry to a credit bureau.

Taneesha Crooks filed a complaint on behalf of individually and on behalf of all others similarly situated on Jan. 31 in the U.S. District Court for the Southern District of California against Wells Fargo Bank NA, formerly known as Wachovia Bank NA, alleging violation of the Fair Credit Reporting Act.

According to the complaint, the plaintiff purchased a vehicle in 2006 that was financed by the defendant. The suit states the plaintiff filed for bankruptcy in 2016 and this debt was discharged in the bankruptcy petition. The plaintiff alleges she examined her Equifax credit report in March 2017 and found that the defendant submitted an unauthorized account review credit report inquiry to the credit bureau. She alleges this inquiry was unauthorized and illegal since she no longer held an account with the defendant.

The plaintiffs request a trial by jury and seek judgment against defendant; award of special, general, compensatory and punitive damages; certify class action; statutory and punitive damages; costs of litigation; attorney’s fees; and other relief the court may deem just.
