Customer blames credit agency for not correcting credit report

LOS ANGELES — A California woman is suing credit reporting agencies, alleging failure to promptly correct identify theft.

Elena P. Relente filed a complaint Jan. 25 in U.S. District Court for the Central District of California against Discover Products Inc., Trans Union, LLC; Experian Information Solutions, Inc. and Does 1 through 10, alleging violation of the Fair Credit Reporting Act.

According to the complaint, in January 2017, Relente informed the defendants and filed a police report after learning she has experienced identity theft. Despite various attempts to provide information and requests to correct her credit report, the suit says, the defendants verified the inaccurate information rather than deleting it. 

As a result, Relente says her credit ratings and creditworthiness have decreased, leading to lost credit limits and missed credit opportunities. 

The plaintiff alleges the defendants failed to conduct a proper investigation of the consumer's credit, failed to review available information and failed to review all information purportedly provided by the credit reporting agencies.

Relente seeks trial by jury, punitive, exemplary, actual and statutory damages, court costs, attorney fees with prejudgment interest, and all other relief the court deems just and proper. She is represented by by attorney Aidan W. Butller of Los Angeles.
