Suit filed against BillMeLater Inc. over collection calls

SACRAMENTO – A California resident alleges a debt collector is unlawfully contacting her.

Janet Hord filed a complaint on Feb. 1 in the U.S. District Court for the Eastern District of California against BillMeLater Inc. and Does 1-100 alleging Telephone Consumer Protection Act, and the Rosenthal Fair Debt Collection Practices Act.

According to the complaint, the plaintiff alleges that she obtained a loan through BillMeLater in 2016 and later was financially unable to keep up with the payments. She alleges she retained counsel and instructed the defendant to cease contacting her for collection purposes in September 2017.

The plaintiff holds BillMeLater Inc. and Does 1-100 responsible because the defendants allegedly contacted plaintiff via telephone despite being notified the plaintiff had retained counsel.

The plaintiff requests a trial by jury and seeks judgment against the defendants, award actual and statutory damages, costs of litigation, attorney’s fees and injunctive relief. She is represented by Scott J. Sagaria, Elliot W. Gale, Joe B. Angelo and Scott M. Johnson of Sagaria Law PC in Roseville.
