SAN DIEGO — A San Diego County woman is suing a financial services business, alleging misrepresentation in debt collection.
Valorie Moser filed a complaint Feb. 1 in U.S. District Court for the Southern District of California against CMRE Financial Services Inc. alleging violation of the Fair Debt Collection Practices Act and the Rosenthal Fair Debt Collection Practices Act.
According to the complaint, on Feb. 15, 2017, Moser was sent a debt collection letter stating her balance due for the IHS Radiology Medical Group debt was $135.52. Moser says the debt collection lists the creditor balance of $67.65 twice with the exact same creditor reference number and the date the debt was incurred.
Moser alleges she was accused of owing a debt that was larger than the actual amount due.
The plaintiff alleges CMRE Financial Services collected a debt that was greater than the amount owned by the consumer, violating FDCPA standards.
Moser seeks trial by jury, actual damages, statutory damages of $1,000, attorney fees, costs, interest, punitive damages and all other relief the court deems just and proper.
