Former Fed Ex worker accuses plan administrator of violating ERISA

LOS ANGELES — A longtime Federal Express worker is suing a plan administrator, alleging violation of the Employees Retirement Income Security Act (ERISA).

Nerses Meguerditchian filed a complaint Feb. 5 in U.S. District Court for the Central District of California against Federal Express Corporation Long Term Disability Plan, Aetna Life Insurance Company and Does 1-10, alleging they violated ERISA through non-payment of plan benefits.

According to the complaint, in December 2010, Meguerditchian injured his back at work while lifting a heavy engine. The suit says since Dec. 6, 2017, Meguerditchian has suffered economic damages from the defendant's decision to uphold denial of the plaintiff's long-term disability benefits of $2,295.24 per month without reasonable grounds, and despite Meguerditchian remaining disabled as defined by the plan. 

The plaintiff alleges the defendants failed to pay long-term disability benefits to him despite knowledge Meguerditchian was entitled to those benefits, and failed to provide a prompt and reasonable explanation of the basis for denying the plaintiff's claim.

Meguerditchian seeks trial by jury, damages, interest, attorney fees, court costs, reinstatement to the plan and all further relief the court deems just. He is represented by attorney Kevin M. Zietz of Law Offices of Kevin M. Zietz PC in Encino.
