Disabled customer accuses gas station/car wash of discrimination

SACRAMENTO — A disabled man who requires a wheelchair, is suing a Sanger gas station/convenience story, alleging disability discrimination.

Jose Acosta filed a complaint Feb. 12 in U.S. District Court for the Eastern District of California against Chhaju Singh Bassi, individually and doing business as Valli Gas & Car Wash, alleging violation of the Americans with Disabilities Act.

According to the complaint, on Oct. 11, 2017, Acosta visited the defendant's facility at 1029 Academy Road, Sanger, for the purpose of purchasing a beverage. Acosta says during his visit he encountered barriers, both physical and intangible, that interfered and outright denied his ability to use and enjoy the goods, services, privileges and accommodations offered at gas station/convenience story.. 

The plaintiff alleges Valli Gas & Car Wash failed to remove architectural barriers in an existing facility, failed to design and construct a facility accessible to disabled persons and failed to comply with the requirements of ADA.

Acosta seeks trial by jury, injunctive relief, preventive relief and all other relief the court deems proper. He is represented by attorney Zachary M. Best of Mission Law Firm APC in San Jose.
