Consumer accuses credit reporting agencies of negligent misrepresentation

SACRAMENTO — A consumer is suing credit reporting agencies, alleging misrepresentation in debt collection.

Sahar Harb filed a complaint Feb. 5 in U.S. District Court for the Eastern District of California against Equifax Inc. First Data Corporation and Does 1 through 100, alleging violation of Fair Credit Reporting Act and California Consumer Credit Reporting Agencies Act.

According to the complaint, on May 31, 2014, Harb filed for Chapter 13 bankruptcy in order to reorganize and repair her credit worthiness for the FICO score. Harb says despite filling a report, the defendants would not accept payments and made no specific change in her credit. 

Harb says she also noticed her credit report was inaccurate, misleading, and incomplete and did not comply with credit reporting industry standards. 

The plaintiff alleges Equifax and First Data failed to establish and follow reasonable procedures to assure maximum possible accuracy in the preparation of a consumer's credit reports and credit files that it published and maintained through their files.

Harb seeks trial by jury, preliminary and permanent injunctive relief, punitive damages, attorney fees and costs of suit. She is represented by attorneys Scott J. Sagaria and Elliot W. Gale of Sagaria Law, PC in Roseville.
