L.A. fabrics business accuses Saks Fifth Avenue of copyright infringement

LOS ANGELES — A Los Angels fabrics business is suing Saks Fifth Avenue and Does 1-10, alleging copyright infringement.

Star Fabrics Inc. filed a complaint Feb. 14 in U.S. District Court for the Central District of California against Saks Fifth Avenue and Does 1-10, alleging they violated laws through unauthorized distribution of an intellectual property.

According to the complaint, Star Fabrics has sustained and will continue to sustain irreparable injury, from Saks' for-profit, unauthorized reproduction, distribution and exploitation of the plaintiff’s copyrighted two-dimensional artwork for use on textiles titled "61931”. 

The plaintiff alleges Saks Fifth Avenue obtained profits it would not otherwise have realized but for its infringement. The suit says Saks created, made and/or developed directly derivative works from the plaintiff's copyrighted design.

Star Fabrics seeks trial by jury, all created or developed derivative works from the ' copyrighted design used without the plaintiff' consent, plus all received money and profits that rightfully belong to the plaintiff. Star Fabrics is represented by attorneys Stephen M. Doniger and Howard S. Han of Doniger / Burroughs in Venice, California.
