Carpenters board alleges audits not properly submitted

LOS ANGELES — A carpenters' board of trustees is suing a construction company, alleging violation of workers compensation acts.

Carpenters Southwest Administrative Corporation and board of trustees for the Carpenters Southwest Trusts filed a complaint Feb. 14 in U.S. District Court for the Central District of California Western Division against S.E. Welco Inc. and Does 1-10, alleging violation of the Labor-Management Relations Act and Employee Retirement Income Security Act.

According to the complaint, between 2012 and 2016, the defendants made, executed and delivered to the plaintiffs' union a memorandum agreement it which it binds them to the terms and condition of the collective bargaining agreement. The suit says the defendants are required to make the fringe benefit contribution by way of employers monthly reports to the plaintiffs' plan but were unable to complete an audit as requested for the purpose of conducting an audit. 

The plaintiffs allege S.E. Welco failed to provide monthly reports or account for all compensation paid to employees performing services covered by the agreements, and failed and refused to allow the plans to complete the audit.

The plaintiffs seek trial by jury, reasonable attorney fees, costs of action, all further contributions according to proof, and all other relief the court deems proper. They are represented by attorney Jodie Siegner of DeCarlo & Shanley in Los Angeles.
