Customer accuses credit reporting agency of violating FCRA

SACRAMENTO — A customer is suing a credit reporting agency, alleging violation of the Fair Credit Reporting Act (FCRA).

Travis Studebaker filed a complaint Feb. 20 in U.S. District Court for the Eastern District of California against Equifax Inc. and Does 1-100, alleging they negligently reported the plaintiff's bankruptcy date. 

According to the complaint, Studebaker has suffered economic loss, damage to reputation, diminished credit, embarrassment, humiliation, and other emotional harm, as a result of Equifax's incorrect reporting of the plaintiff's date of bankruptcy. The suit says Studebaker had to spend $39.95 to make sure the inaccuracies were corrected. 

The plaintiff alleges the defendants failed to establish and/or to follow reasonable procedures to assure accuracy in the preparation of Studebaker's credit reports, and failed to re-investigate the disputed information.

Studebaker seeks trial by jury, preliminary and permanent injunctive relief, punitive damages, attorney fees and costs of suit. He is represented by attorneys Scott J. Sagaria and Elliot W. Gale of Sagaria Law PC in Roseville.
