Consumer accuses telemarketer of phone harassment

LOS ANGELES — An Arleta man has filed a class action lawsuit against a telemarketer and seller of loans, alleging violation of telephone harassment statutes.

Miguel Napoles, individually and on behalf of all others similarly situated, filed a complaint Feb. 27 in U.S. District Court for the Central District of California against Loandepot.com, LLC, and Does 1 through 10, alleging violation of the Telephone Consumer Protection Act.

According to the complaint, in April 2017, Napoles and the class began receiving calls on their cellular telephones from Loandepot,com attempting to solicit their services. Napoles say they received numerous solicitation calls within a 12-month period, as the defendant illegally used an automatic telephone dialing system or an artificial or prerecorded voice, despite the plaintiffs having no prior relation to the defendant. 

The plaintiffs alleges Loandepot.com failed to establish and implement reasonable practices and procedures, violating the regulations of TCPA.

Napoles seeks trial by jury, statutory and treble damages up to $1,500 for each violation and all other relief the court deems just and proper. The plaintiffs are represented by attorney Todd M. Friedman of Law Offices of Todd M. Friedman PC in Woodland Hills.
