Woman files disability discrimination suit against Les Concierges

SAN FRANCISCO – A woman alleges her San Francisco employer failed to accommodate her wrist injury.

Aimie McDaniel filed a complaint on March 7 in the San Francisco County Superior Court against Les Concierges Inc., Accor Business and Leisure Management LLC and Does 1-10 alleging failure to make reasonable accommodation, disability discrimination and other counts.

According to the complaint, the plaintiff began her employment with Les Concierges in March 2008 as a concierge. She alleges in August 2016, at the request of her doctors, she requested an ergonomic evaluation of her work station to accommodate her wrist injury. The suit states she was taken off the schedule with no return date in August 2016. She alleges the defendants denied the request in July 2017.

The plaintiff holds Les Concierges Inc., Accor Business and Leisure Management LLC and Does 1-10 responsible because the defendants allegedly refused to provide plaintiff with reasonable accommodation and instead placed her on leave. She also alleges that she was not paid overtime premiums from March 2015 to March 2016 for hours worked over 40 per week.

The plaintiff requests a trial by jury and seeks judgment against defendants for damages, injunctive relief, restitution, award lost wages, disgorgement of all wages withheld, statutory and civil penalties, attorney's fees, costs, interest, punitive damages and further relief as the court deems just. She is represented by Ramsey Hanafi of Quintana Hanafi LLP in San Francisco.
