SAN FRANCISCO – A San Francisco property owner alleges that a real estate broker misrepresented information about property taxes and the transfer of a deed.

Linda Quang filed a complaint on March 16 in the Superior Court of California - County of San Francisco against Thomas Nguyen, doing business as UP Real Estate & Property Services, and Does 1 to 25 alleging breach of fiduciary duty and professional negligence.

According to the complaint, the plaintiff owns an Orsi Circle property in San Francisco and consulted with Nguyen in March 2016 regarding deeding the property to her sister. She alleges that Nguyen represented that the property would not be reassessed for property taxes when the property was deeded.

The plaintiff alleges this statement was false and as a result of the deed transfer, the taxes on the property increased.

The plaintiff holds Nguyen, doing business as UP Real Estate & Property Services, and Does 1 to 25 responsible because the defendant allegedly failed to act in the best interest of his clients by advising to deed the property in the circumstances and by misrepresenting that the property would not be reassessed upon transfer.

The plaintiff seeks judgment for actual and special damages, restitution and disgorgement of ill-gotten gains, costs of suit and such other and further relief as the court may deem proper. She is represented by Patrick J. Connolly of Utrecht & Lenvin LLP in San Francisco.
