Diversified Consultants alleged to have ignored cease and desist letter from Del Mar man

SAN DIEGO – A Del Mar consumer alleges a Florida-based debt collector ignored his cease and desist letter to stop calling him.

Robert B. Latko filed a complaint on April 4 in the U.S. District Court for the Southern District of California against Diversified Consultants Inc. over alleged violation of Fair Debt Collection Practices Act and Rosenthal Fair Debt Collection Practices Act.

According to the complaint, the plaintiff alleges that on Nov. 20, 2017, he was contacted by defendant via telephone in an attempt to collect an alleged debt. The plaintiff states he mailed a letter to the defendant requesting that it cease all further calls to his number but claims the request was ignored and defendant continued calling. 

The plaintiff holds Diversified Consultants Inc. responsible because the defendant allegedly caused his phone to ring with the intent to annoy, abuse and harass the plaintiff.

The plaintiff requests a trial by jury and seeks judgment for actual and statutory damages, costs of litigation, attorneys' fees, punitive damages and such other and further relief as may be just and proper. He is represented by Trinette G. Kent of Lemberg Law LLC in Phoeniz, Arizona.
