ConsumerTrack alleged to have used photo on websites without permission

SAN DIEGO – A photography studio alleges an El Segundo internet marketing services corporation used a photograph without license or permission.

Fotohaus LLC filed a complaint on April 6 in the U.S. District Court for the Southern District of California against ConsumerTrack Inc. alleging copyright infringement.

According to the complaint, the plaintiff alleges that its owner, Daniel Foster, created an image titled "Online Banking" in 2014 that was "designed to convey the message of online shopping and online banking with a credit card." The plaintiff alleges the defendant copied the photograph and has used it on websites without permission or license.

The plaintiff holds ConsumerTrack Inc. responsible because the defendant allegedly failed to compensate plaintiff for its purported unauthorized exploitation.

The plaintiff requests a trial by jury and seeks judgment against defendant, award of monetary damages, profits, unjust enrichment, costs, attorney’s fees and further relief as the court deems just.
