Pedestrian alleges she was injured trying to avoid being hit by Ace Xpress tour bus

SAN FRANCISCO – A San Bernardino County resident alleges she was injured while attempting to avoid being hit by a tour bus.

Ella May Rogers filed a complaint on April 9 in the San Francisco County Superior Court against Ace Xpress Charter, Ace Tour and Charter, Hai Ru Zhu alleging negligence.

According to the complaint, the plaintiff was lawfully crossing the intersection at the corner of Fourth and Mission Streets in San Francisco on Nov. 29, 2016. She alleges as she was crossing, Zhu was operating the tour bus at a fast rate of speed coming toward her so she began to run. She alleges she fell forward onto the asphalt and sustained severe injuries to her face, jaw and other extremities. 

The plaintiff holds Ace Xpress Charter, Ace Tour and Charter, Zhu and Does 1-25 responsible because Zhu allegedly failed to yield to the right of way to pedestrians crossing the roadway within a marked crosswalk and Ace negligently and carelessly entrusted their vehicle.

The plaintiff requests a trial by jury and seeks judgment against defendants for general, special and compensatory damages; interest; costs of suit; and further relief as the court may deem just. She is represented by Tristan G. Pelayes and Jacob P. Menicucci of Wagner & Pelayes LLP in Riverside.
