Man claims Dent-A-Med Inc. called him to collect alleged debt without consent

LOS ANGELES – A Los Angeles County man alleges that a debt collector invaded his privacy with its collection calls.

Miguel Napoles filed a complaint individually and on behalf of all others similarly situated on April 10 in the U.S. District Court for the Central District of California against Dent-A-Med Inc., doing business as HC Processing, and Does 1-10 alleging violation of the Telephone Consumer Protection Act.

According to the complaint, the plaintiff alleges that in April 2017, the defendants began contacting him in an attempt to collect an alleged debt through the use of an automated dialing system.

The plaintiffs hold Dent-A-Med Inc. and Does 1-10 responsible because the defendants allegedly failed to put in place reasonable policies and procedures to avoid violation of the TCPA, contacted plaintiff without express consent and invaded plaintiff's privacy.

The plaintiffs request a trial by jury and seek judgment against the defendants for statutory damages up to $500 for every violation, treble damages up to $1,500 for every willful violation, actual damages, costs, attorney's fees and further relief as may be just.
