Man alleges McPhail's Inc., others failed to warn of asbestos dangers

SAN FRANCISCO – A man alleges he was injured due to exposure to asbestos.

Jesse Polk filed a complaint on April 20 in the Superior Court of California - County of San Francisco against McPhail's Inc.; Metropolitan Life Insurance Co.; Rafael Lumber; Industrial Holdings Corp. and Does 1 through 800, alleging negligence, products liability and other counts.

According to the complaint, the plaintiff alleges that he has used, handled, or was otherwise exposed to asbestos and asbestos-containing products made by defendants, which has caused him permanent injuries including breathing difficulties, pleural disease, asbestosis and other lung damage and/or cancer. 

The plaintiff alleges that the defendants defectively designed asbestos and asbestos-containing products and failed to warn of the potential safety hazards of the products.

The plaintiff seeks judgment for general damages, exemplary or punitive damages and such other and further relief as the court may deem just and proper. He is represented by Alan R. Brayton, David R. Donadio, James P. Nevin and Nancy T. Williams of Brayton & Purcell LLP in Novato.
