Tenant alleges she was wrongfully evicted from San Francisco property

Contract 01

SAN FRANCISCO – A woman alleges she was wrongfully evicted from a San Francisco property after residing there for nearly 20 years.

Ikeda Brown filed a complaint on April 23 in the San Francisco County Superior Court against Robert Wolterbeek, Edith Wolterbeek and Does 1-10 alleging wrongful eviction, fraud and other counts.

According to the complaint, the plaintiff alleges that on July 15, 2017, she suffered out-of-pocket costs, severe physical, mental and emotional pain, injury and distress from being forced by the defendants to permanently vacate a College Avenue, San Francisco property. The suit states she had resided at the location since 1997.

The suit states the plaintiff was evicted because the defendants told her they intended to use the property as their principal place of residence, but instead rented it to another tenant.

The plaintiff holds Robert Wolterbeek, Edith Wolterbeek and Does 1-10 responsible because the defendants allegedly knowingly violated the rent ordinance.

The plaintiff seeks judgment against the defendants for general, special and punitive damages; attorney's fees; injunctive relief; and further relief as the court deems just. She is represented by Daniel W. Wayne of Law Offices of Daniel W. Wayne in San Francisco.
