San Francisco condo unit owner alleges tenants of neighboring unit make 'severe' levels of noise

SAN FRANCISCO – A condo unit owner has filed a suit against the owners of a neighboring unit over the alleged noise made by their tenants.

Frances Palomar filed a complaint on April 25 in the Superior Court of California - County of San Francisco against Boris Aronshtam, Milada Belaya and Does 1-10 alleging nuisance, negligence, breach of contract and other counts.

According to the complaint, the plaintiff alleges that in June 2016, she purchased a condo unit located at 779 La Playa St., San Francisco and the unit is alongside defendants' two-story unit. The suit states the defendants rent the unit to a couple and "their six-plus children ranging in ages from about 7 months old to about 20 years old."

The plaintiff claims the tenants cause "severe noise" at all hours of the day and night that interrupts her work while she is at home and her sleeping time. 

The plaintiff holds Aronshtam, Belaya and Does 1-10 responsible because the defendants allegedly failed to promptly and adequately respond to her nuisance complaints and allowed their tenants to unreasonably interfere with her quiet enjoyment.

The plaintiff seeks judgment for general, special and punitive damages; prejudgment interest; costs of suit; attorney fees and such other and further relief as the court deems just and proper.
