Former Hayes Valley Inn Associates employee alleges he is owed unpaid overtime wages

SAN FRANCISCO – A former manager of a San Francisco property alleges he was misclassified as being exempt from overtime pay.

SAN FRANCISCO – A former manager of a San Francisco property alleges he was misclassified as being exempt from overtime pay.

Brian Lenahan filed a complaint on May 2 in the San Francisco County Superior Court against Hayes Gough LLC, Hayes Valley Inn Associates LLP, et al. alleging violation of California Labor Code.

According to the complaint, the plaintiff was employed by the defendants at the Hayes Valley Inn and was asked to be the residential manager in April 2016. He alleges he was designated salary exempt and was on call any time of day or night. He alleges he did not meet the exempt request and his employment classification was changed back to hourly in June 2017. He alleges he eventually resigned in August 2017 because the working conditions became intolerable.

The plaintiff holds Hayes Gough LLC, Hayes Valley Inn Associates LLP, et al. responsible because the defendants allegedly failed and refused to pay plaintiff with overtime and on-call compensation, misclassified plaintiff in direct violation of the labor code, and failed to provide mandatory rest and meal break periods.

The plaintiff requests a trial by jury and seeks judgment against the defendants for general, special, punitive and exemplary damages; unpaid overtime wages; interest; penalties; attorney's fees; costs; and further relief as the court deems just.
