SACRAMENTO – An Oroville consumer alleges he was injured by a defective blender that failed during normal use.
Noel Cogburn filed a complaint on May 14 in the U.S. District Court for the Eastern District of California against Sunbeam Products Inc., doing business as Jarden Consumer Solutions, and Walmart Inc. alleging negligence, strict liability and breach of implied warranty.
According to the complaint, the plaintiff alleges that on April 13, 2017, he was using an Oster Accurate Blend 14 blender to make hummus when the pitcher detached from the threaded blade attachment and exposed the blade assembly, which caused lacerations to his hands. The suit states the plaintiff purchased the blender from Walmart and that it was manufactured by Sunbeam.
The plaintiff holds Sunbeam Products Inc. and Walmart Inc. responsible because the defendants allegedly negligently produced, manufactured, marketed and sold the blender in a defective and dangerous condition.
The plaintiff requests a trial by jury and seeks judgment against defendants for compensatory and general damages, interest, attorney's fees, expert/consultant fees, costs of suit, and further relief as the court deems just.
