Benjamin Construction & Development alleged to have failed to pay monthly contributions to trust funds

LOS ANGELES – The administrator of employee benefit plans alleges that a Gardena employer owes more than $40,000 in unpaid contributions.

Construction Laborers Trust Funds for Southern California Administrative Co. filed a complaint on May 7 in the U.S. District Court for the Central District of California against Benjamin Construction & Development Inc., also known as Benjamin Construction and Development Inc., over allege violation of the Employee Retirement Income Security Act.

According to the complaint, the plaintiff alleges that under the terms of the construction master labor agreements, the defendant is required to submit monthly fringe benefits contributions to each of the trust funds on behalf of their employees. 

The plaintiff holds Benjamin Construction & Development, Inc. also known as Benjamin Construction and Development Inc., responsible because the defendant allegedly failed to submit monthly contributions due by to the trust funds for laborers' work amounting to $44,293.20 in unpaid or late-paid monthly contributions and related damages for the period December 2016 through July 2017.

The plaintiff seeks injunctive relief, reasonable attorneys' fees, costs of suit and for such other relief that the court deems appropriate. It is represented by Alexander B. Cvitan, Marsha M. Hamasaki and Peter A. Hutchinson of Reich, Adell & Cvitan in Los Angeles.
