LOS ANGELES – A Los Angeles County man alleges a debt collector would hang up when he answered the call.
R. Ted Kennedy filed a complaint on May 8 in the U.S. District Court for the Central District of California against Portfolio Recovery Associates LLC and Does 1-10 citing the Fair Debt Collection Practices Act.
According to the complaint, the plaintiff alleges that the defendant is attempting to collect two debts with Capital One from the plaintiff. He alleges he never had two debts from Capital One and that he disputed the credit reporting of the debts. The suit also states that the defendant would call and then hang up when the plaintiff answered.
The plaintiff holds Portfolio Recovery Associates LLC and Does 1-10 responsible because the defendants allegedly failed to indicate that all communications were from a debt collector and attempted to collect an amount not authorized by an agreement.
The plaintiff requests a trial by jury and seeks judgment against defendants for actual, statutory and punitive damages; costs; attorney's fees; and further relief as the court may deem just. He is represented by Jeremy S. Golden of Golden & Cardona-Loya LLP in Chula Vista.
