LOS ANGELES – A patron at La Puente restaurant alleges he encountered barriers that limited his access because of his wheelchair.
Luis Villegas filed a complaint on May 7 in the U.S. District Court for the Central District of California against La Puente Co. LLC, Taco Del Rio Inc. and Does 1-10 alleging violation of the Americans with Disabilities Act and the Unruh Civil Rights Act.
According to the complaint, the plaintiff alleges that in October 2017, he went to the defendants' property to eat at the Taco Del Rio. He alleges the parking spaces reserved for customers with disabilities, restrooms and the transaction counters were not in compliance with the ADA.
The plaintiff holds La Puente Co. LLC, Taco Del Rio Inc., and Does 1-10 responsible because the defendants allegedly failed to remove the architectural barriers when such removal was readily achievable.
The plaintiff seeks judgment against defendants for damages, injunctive relief, attorney's fees, litigation expenses and costs of suit. He is represented by Chris Carson, Ray Ballister Jr., Phyl Grace and Dennis Price of Center for Disability Access in San Diego.
