Texkhan alleges two California businesses used textile design without permission

LOS ANGELES – A Santa Fe Springs corporation and a Los Angeles corporation are alleged to have unlawfully used a Korean corporation's textile design in clothing.

Texkhan Inc., doing business as HyupSung TRD Co. LTD, filed a complaint on May 7 in the U.S. District Court for the Central District of California against Windsor Fashions Inc.; Polymond DK Inc., doing business as Millibon; and Does 1-10 alleging copyright infringement.

According to the complaint, the plaintiff owns and composed an original, two-dimensional artwork known as HA-3156. It alleges the defendants created, manufactured or imported fabric and clothing bearing this design without the plaintiff's authorization.

The plaintiff holds Windsor Fashions Inc., Polymond DK Inc. and Does 1-10 responsible because it allegedly suffered substantial damages as a result of the defendants' actions.

The plaintiff requests a trial by jury and seeks judgment against the defendants, accounting of their profits from infringement, attorneys’ fees, prejudgment interest, costs of action, and further legal and equitable relief as the court deems proper. It is represented by Stephen M. Doniger, Scott Alan Burroughs, Trevor W. Barrett and Justin M. Gomes of Doniger/Burroughs in Venice.
