SACRAMENTO – A Hughson consumer alleges a debt collector used unfair and unconscionable means to collect a debt.
Samantha Castillo filed a complaint on May 23 in the U.S. District Court for the Eastern District of California against United Recovery Solutions Inc. alleging violation of the Fair Debt Collection Practices Act and the Rosenthal Fair Debt Collection Practices Act.
According to the complaint, the plaintiff alleges that on March 8, the defendant contacted her regarding an alleged debt from a flute she purchased for her minor daughter on credit. She alleges she told the defendant she was unable to pay the alleged debt and that it responded “We will go to your daughter’s school and repossess the flute and tell her that you are a bad mom who does not pay her bills.”
The plaintiff holds United Recovery Solutions Inc. responsible because the defendant allegedly made an unconscionable and egregious threat without any intent to carry it out to harass and pressure her into making a payment.
The plaintiff requests a trial by jury and seeks judgment against defendant for actual and statutory damages, costs of litigation, punitive damages, and further relief as may be just. She is represented by Trinette G. Kent of Lemberg Law LLC in Phoenix, Arizona.
