Amtrak passenger seeks damages over 2016 train/truck collision

SACRAMENTO – An Amtrak passenger is seeking damages over allegations he was injured when the train collided with a truck and trailer in San Joaquin County.

Anthony Allen filed a complaint on May 21 in the U.S. District Court for the Eastern District of California against Rene Ramirez Bernal; A & I Transport Inc.; Gregory A. Meredith; National Railroad Passenger Corp., doing business as Amtrak; and Does 1-20 alleging negligence.

According to the complaint, the plaintiff alleges that on Aug. 15, 2016, he was a passenger on an Amtrak train operated by Meredith. The suit states Bernal and A & I Transport caused a truck and trailer to be stationed across railroad tracks on Whiskey Slough Road in San Joaquin County and the Amtrak train collided with it. The plaintiff alleges he was injured in the collision.

The plaintiff holds Bernal, A & I Transport Inc., Meredith, National Railroad Passenger Corp. and Does 1-20 responsible because the defendants allegedly breached their duty of care.

The plaintiff requests a trial by jury and seeks judgment against the defendants for general, compensatory, special and consequential damages; interest; costs of suit; attorney's fees; and further relief as the court deems just.
