LOS ANGELES – A West Hollywood real estate agency is alleged to have used a copyrighted engagement photo on its website without the photographer's authorization.
Adam George filed a complaint on May 18 in the U.S. District Court for the Central District of California against Jennie Martin, Keller Williams Realty Hollywood Hills and Does 1-10 alleging copyright infringement.
According to the complaint, the plaintiff owns an original photograph titled "Hafen/Bishop Engagement Shoot" that was registered in 2014 with the U.S. Copyright Office. He alleges the defendants used the photo without authorization on the website www.jenniemartinrealestate.com.
The plaintiff holds Martin, Keller Williams Realty Hollywood Hills and Does 1-10 responsible because the defendants allegedly used the copyrighted photograph without his consent and received money and profits they would not have realized but for their infringement.
The plaintiff requests a trial by jury and seeks judgment against defendants, award all profits from infringement, attorney's fees, interest, costs of action and further relief as the court deems just. He is represented by Stephen M. Doniger, Scott A. Burroughs and Frank Gregory Casella of Doniger/Burroughs in Venice.
