Former Majestic Hotel cook alleges he is owed unpaid wages

SAN FRANCISCO – A San Francisco hotel is alleged to have failed to pay a former cook for all hours that he worked.

Benito Nunez filed a complaint on May 17 in the Superior Court of California - County of San Francisco against 1500 Majestic LLC, Vikas Patel, Varsha Patel, Charlie Patel and Does 1-25, doing business as Majestic Hotel, over alleged violations of the California Labor Code and other counts.

According to the complaint, the plaintiff worked for the defendants as a cook from 2006 to November 2017. He alleges that the defendants gave him wage statements that failed to accurately reflect his wages earned and hours worked.

The plaintiff holds the defendants responsible because the defendants allegedly failed to compensate him for hours worked, paid him at a rate lower than the minimum wage and failed to pay overtime wages.

The plaintiff requests a trial by jury and seeks judgment for unlawful termination; award of general, liquidated and punitive damages and lost wages. He is represented by Nephtali Gonzales of NephtaLaw in Oakland.
