Mechanic alleges back injury was factor in termination from Clawson Motorsports

FRESNO – A Madera County man alleges that his former Fresno employer terminated him after he was injured on the job.

Thomas Aguayo filed a complaint on May 23 in the Fresno County Superior Court against James McKoane Enterprises Inc., doing business as Clawson Motorsports, and Does 1-20 alleging wrongful discharge and violation of the Fair Employment and Housing Act.

According to the complaint, the plaintiff was hired by the defendants as a motorcycle mechanic in April 2015. The suit states on April 7, 2016, he injured his back during the course of his employment with the defendants and filed a workers' compensation claim. He alleges he returned to work in July 2016 with a lifting restriction from his physician and was terminated the same month.

The plaintiff holds James McKoane Enterprises Inc. and Does 1-20 responsible because the defendants allegedly terminated him because of his back injury

The plaintiff requests a trial by jury and seeks judgment against defendants for actual, special, general, compensatory and punitive damages, costs of suit, interest, attorney's fees, and all other relief as the court deems just.
