Homeowners allege houses have defects, seek cost of repairs from Evergreen Communities

FRESNO – Several owners of Fresno County homes allege that the properties have defects and are seeking costs for repairs from the developers.

Robert Bonilla, Angel Orosco and Cristina Lopez, et al. filed a complaint on May 22 in the Fresno County Superior Court against Evergreen Communities Inc., Evergreen Royal Woods LLC and Does 1-1,000 alleging breach of contract, violation of building standards and other counts.

According to the complaint, the plaintiffs purchased properties from the defendants, who were either the general contractors or developers of the homes. They allege the properties are defective because the defendants did not construct them in a workmanlike manner. 

The plaintiffs allege the homes have water, structural and fire protection issues.

The plaintiffs hold Evergreen Communities Inc., Evergreen Royal Woods LLC and Does 1-1,000 responsible because the defendants allegedly failed to provide properties constructed in a workmanlike manner.

The plaintiffs request a trial by jury and seek judgment against the defendants, award costs of restoration and repairs of more than $50,000 per home, costs of investigation, diminution of value, expert fees and costs of suit and further relief as the court deems just. They are represented by Joseph J. Su of Milstein Jackson Fairchild & Wade LLP in Los Angeles.
