Children of woman killed in tractor-trailer collision file wrongful death suit against Fernandez Trucking, others

FRESNO – The surviving children of a woman who died after her vehicle was rear-ended by a tractor-trailer in Fresno County have filed a wrongful death suit against the parties allegedly involved in the collision.

Daniel Gordillo as guardian ad litem for Jacquelyn Duarte; Juan J. Duarte, Stephanie Duarte, minors; and Miguel Duarte filed a complaint on May 24 in the Fresno County Superior Court against Uvaldo Fernandez, individually and doing business as Fernandez Trucking; Thermo King Fresno Inc., et al. alleging wrongful death.

According to the complaint, the plaintiffs allege that on Oct. 2, 2017, their mother, Alma Berenice Gordillo, died after her 1999 Ford F-150 was struck in the rear by a tractor-trailer driven by Fernandez on Freeway 99 in Fresno County. The suit states the impact caused the Gordillo vehicle to strike the rear of a Thermo King Fresno trailer.

The suit states the trailer Fernandez was hauling was overloaded with a load of almonds and the driver of the Thermo King trailer was driving on an expired or suspended license.

The plaintiffs seek judgment for non-economic damages, loss of future earnings, compensatory damages, costs of suit, pre- and post-judgment interest, and all other relief the court deems just and proper. They are represented by H. Ty Kharazi and Nicholas E. Aniotzbehere of Yarra Law Group in Fresno.
