Double Image Barber Shop in El Cajon alleged to not have accessible parking

SAN DIEGO – A paraplegic alleges that an El Cajon property no longer has accessible parking spaces for patrons with disabilities.

Chris Langer filed a complaint on June 3 in the U.S. District Court for the Southern District of California against Kelly T. Vaiasuso, Salwan Najeeb Kariakos and Does 1-10 citing the Americans with Disabilities Act and the Unruh Civil Rights Act.

According to the complaint, the plaintiff alleges that in May, he visited the Double Image Barber Shop location owned and/or operated by the defendants to get a haircut. He alleges there were no compliant, accessible parking spaces reserved at the location and he was denied full and equal access as a result.

The plaintiff holds Vaiasuso, Kariakos and Does 1-10 responsible because the defendants allegedly failed to maintain features of the facility in operable working condition to be readily accessible by persons with disabilities.

The plaintiff seeks judgment against defendants for damages, injunctive relief, actual damages and a statutory minimum of $4,000, attorney's fees, litigation expenses and costs of suit. He is represented by Chris Carson, Raymond Ballister Jr., Phyl Grace and Dennis Price of Center for Disability Access in San Diego.
