Consumer claims Ford Fusion has defects, seeks replacement or restitution

FRESNO – A Ford vehicle purchased by a Palier consumer is alleged to have defects that have not been repaired despite attempts to do so.

Santa Calleres filed a complaint on May 29 in the Fresno County Superior Court against Ford Motor Co. and Does 1 to 10 over alleged violation of the Song Beverly Consumer Warranty Act.

According to the complaint, on May 10, 2013, the plaintiff purchased a 2013 Ford Fusion hybrid for the total amount of $50,498.16, which was accompanied with written and other express warranties. The plaintiff claims the vehicle was delivered with serious defects and nonconformities to warranty that allegedly substantially impaired the use, value, or safety of the vehicle. 

The suit states that despite delivering the vehicle to authorized repair and service facilities, the defects allegedly continue to exist even after a reasonable number of repair attempts. 

The plaintiff holds Ford Motor Co. responsible because the defendant allegedly failed to service and/or repair the vehicle to match the written warranty’s requirements after a reasonable number of opportunities and/or amount of time to do so.

The plaintiff seeks replacement or restitution, incidental and consequential damages, actual attorneys' fees, costs of suit, expenses, prejudgment interest, and for such other relief as the court deems appropriate. The plaintiff is represented by David A. Goldsmith of Goldsmith West in Los Angeles.
