SAN DIEGO – A leasing agent has filed a class-action lawsuit against a real estate investment company over allegations of failure to pay overtime wages.
Elizabeth Cuevas, as an individual and on behalf of all others similarly situated, filed a complaint on June 6 in the U.S. District Court for the Southern District of California against Conam Management Corp. and Does 1 through 10 over alleged violation of the Fair Labor Standards Act.
According to the complaint, the plaintiff was hired by the defendant in December 2017 as a nonexempt leasing agent at a Reno, Nevada residential property.
The plaintiff holds Conam Management Corp. responsible because the defendant allegedly failed to compensate employees at a rate of no less than one-and-one-half times their regular rate of pay for work performed in excess of 40 hours in a workweek.
The plaintiff requests a trial by jury and seeks liquidated damages, compensatory damages, interest, attorneys’ fees, costs and all such other legal and equitable relief as the court deems just and proper.
